An example of a decretal - The Collectio Francofurtana

This page contains an example of a decretal which is present in the so called Collectio Francofurtana from the late twelfth century. Friedrich Heyer did notice in 1915 the decretal manuscript in Frankfurt am Main. Stephan Kuttner, born in this town, recognized in 1933 it as a systematically organized decretal collection. A more exact date or the location where it was first put together cannot be given, and several hypotheses have been proposed. The images stem from microfilms lent gracefully by the Stephan Kuttner-Institute of Medieval Canon Law. At this institute Gisela Drossbach prepared an edition, together with Peter Landau. She has also put the card files of Walther Holtzmann for his overview of Decretalium duodecimi saeculi into an updated online consultable database. The Collectio Francofortana survives in four manuscripts, which each have been asigned a siglum:

The decretal "Referente nobis I." of pope Alexander III 1162-1175) serves here as an example, first of having to decipher handwrtings that are not easy to decipher, and secondly of the decisions to be taken in preparing a critical text edition. Holtzmann gave this decretal the number 858 in his list of Decretalium Duodecimi Saeculi; Jaffé-Loewe, Regesta pontificum romanorum noted it as no. 14168. The text of this decretal is edited from three manuscripts of the Collectio Francofortana, with the sigla F (Frankfurt), T (Troyes) and R (Paris).

Translation

Alexander to the bishop of C. We take it from I., a priest who tells us the present things, that when he had two churches the archdeacon robbed him of one church and assigned the other to a priest named G. The aforementioned I. felt himself aggravated in this and he appealed to the archbishop of Reims, and when G. was to be restored on order of that same archbishop, he appealed to [have a hearing at] our court. Therefore we order you as a friend to convocate the parties involved and to let I. choose that church of the two with all that belongs to it which he would want, the other is left to G. If he has no church, you should not hesitate to assign him it. However, if he has another benefice, then assign it without delay to any priest who does not have an ecclesiastical benefice.
